The European Commission has launched a call for expression of interest for the Board of Appeal of the three European Supervisory Authorities, EBA, EIOPA and ESMA, with applications due by noon on 8 June 2026, ESMA said.
The Board of Appeal is the body that hears challenges to certain decisions made by the ESAs. It provides a formal route of review for firms or other parties contesting a supervisory decision before any further appeal to the Court of Justice of the European Union.
Reserve list, not immediate appointments
The call aims to create a reserve list of qualified candidates, valid for five years from adoption. Inclusion on the list does not guarantee appointment. When a vacancy arises, the Management Board of the relevant ESA, after consulting its Board of Supervisors, selects a candidate from the pool. Nominees may also be invited by the European Parliament to make a statement and answer questions.
The Board of Appeal is a joint body of the ESAs, established under their founding regulations. It operates independently and rules on appeals against certain ESA decisions under Article 60 of those regulations. It currently comprises six members and six alternates, drawn from legal academia, counsel and investor representation backgrounds, ESMA’s governance page shows.
The Board has issued decisions in recent cases. In August 2024, it unanimously dismissed an appeal by Euroins Insurance Group AD against EIOPA. In January 2026, it ruled on reimbursement of costs in a case brought by NOVIS Insurance Company against EIOPA. ESMA is providing the Board’s rotating secretariat in 2026.
